These Terms of Service (“Terms”) govern your access to and use of Rate Desk, the lead-line platform (the “Service”), operated by GetGod.Life LLC, a Florida limited liability company (“Rate Desk,” “we,” “us”). By creating an account, subscribing, registering on a landing page, or otherwise using the Service, you agree to these Terms.
Rate Desk provides insurance agencies and similar organizations ("Organizations") with tools to operate a text-based Rate Desk line, including a dedicated phone number, a public landing page, a team inbox, message templates, notifications, and related features. Individuals ("Members of the Public") may use an Organization's landing page or phone number to ask a question.
THE SERVICE IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES, CRISIS INTERVENTION, OR PROFESSIONAL CARE. If you or someone you know is in danger or experiencing a medical or mental-health emergency, call 911 (or your local emergency number) or the 988 Suicide & Crisis Lifeline immediately. Lead messages are read and answered by staff members of independent Organizations, not by licensed counselors, and responses are not guaranteed within any particular timeframe.
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. Each Organization is responsible for its team members, its use of the Service, and its conduct toward the people it serves. Organizations must be legitimate insurance agencies or similar organizations, and must designate administrators who accept these Terms on the Organization's behalf.
The Service sends and receives SMS text messages. By providing a mobile number and opting in - whether through a landing page registration, by texting an Organization's Rate Desk line, or otherwise - you consent to receive text messages related to that Rate Desk line, including a greeting message, replies from the team, and service notifications. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of texts from a given number; reply START to resume. Opting out by text cannot be reversed through the website - only texting START restores messages, consistent with carrier rules. Organizations are responsible for using messaging features lawfully, including compliance with the Telephone Consumer Protection Act (TCPA) and applicable carrier requirements.
Lead requests may contain deeply personal information. Organizations and their team members agree to treat all lead content with dignity and confidentiality, to use it solely for serving the person who sent it, and never to sell it or use it for unrelated marketing. All users agree not to use the Service to harass, abuse, threaten, or deceive anyone; to send spam or unlawful content; to impersonate others; or to violate any law. We may suspend or terminate accounts that violate this section.
Paid plans are billed in advance through our payment processor, Stripe, on a monthly or annual basis, and renew automatically until cancelled. Current pricing is displayed on the Get Started page in the app. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period, and previously paid fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply at your next renewal. Failure of payment may result in suspension of the Service after a reasonable grace period.
Rate Desk offers a single-tier referral program ("Rate Desk Partners"). Participation is subject to application, approval, and a separate Partner Agreement. Partners are independent contractors, not employees or agents of Rate Desk, and must clearly disclose their affiliate relationship in all promotions as required by the FTC. Commissions, rates, and payout terms are described in the Partner Agreement and may be updated prospectively. We may suspend or terminate partners who engage in misleading, unlawful, or brand-damaging promotion.
The Service, including its software, design, and content we provide, is owned by GetGod.Life LLC and protected by law. We grant Organizations and users a limited, non-exclusive, non-transferable right to use the Service as intended during their subscription. You retain rights to content you submit; you grant us the limited license needed to operate the Service (for example, storing and transmitting lead messages to the intended Organization).
Our collection and use of personal information is described in our Privacy Policy, available in the app, which is incorporated into these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED OR ANSWERED. SUPPORT IS PROVIDED BY INDEPENDENT ORGANIZATIONS, NOT BY RATE DESK. NOTHING IN THE SERVICE CONSTITUTES FINANCIAL, TAX, OR LEGAL ADVICE. RATE DESK AND ITS ORGANIZATIONS ARE NOT BANKS AND NOT LAW FIRMS; ANNUITY AND INSURANCE PRODUCTS ARE OFFERED BY LICENSED AGENTS, AND ESTATE DOCUMENTS ARE PREPARED BY LICENSED ATTORNEYS.
TO THE FULLEST EXTENT PERMITTED BY LAW, GETGOD.LIFE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS PAID BY THE APPLICABLE ORGANIZATION TO RATE DESK IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS FOR USERS WITHOUT A PAID SUBSCRIPTION.
Organizations agree to indemnify and hold harmless GetGod.Life LLC from claims arising out of their use of the Service, their content, their team members' conduct, or their violation of these Terms or applicable law, including messaging-consent laws.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, legal risk, or discontinuation of the Service, with reasonable notice where practicable. Sections that by their nature should survive termination (including 8, 10, 11, 12, and 14) survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Marion County, Florida, and the parties consent to their jurisdiction.
We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new "Last updated" date and, for significant changes, by email or in-app notice. Continued use after changes take effect constitutes acceptance.
